    I dont know if anyone can give me some advice on this but here i am anyway!

    Has i said a while ago, while coming home my, daughter was attacked at our local train station, and the girls responsible are being taken to court for "

    1, endangering tasha's (my daughter) life,
    2. endangering the lives of the train drivers
    3. assault
    and 4. endangering thelives of the people n the train,

    now i ahvent been to court with my daughter before (thank god) and i have no idea what to expect, these girls have already attacked my daughters friend, becuase he gave a statement, and they wanted him to drop the statement.

    now what i am asking is, will these girls be allowed near my daughter in the court? she is giving evidence over a video link, but i dont trust the girls, they are also blaming each other for it, "she did it, no she did it " sort of thing. now why cant the courts do both girls? they were both there, they are BOTh responsible for the crime, because in my eyes, one of them attacked tasha and the other egged the girl on, and didnt do anything to stop it.

    so what can i expect? anyone know.

    I'm sure your lawyer would know.
    But if she is giving testimony via video link, she won't even see them, let alone be in the same room as them.

    Since the offenders know who is testifying against them why isn't your

    daughter going to go into the regular courtroom to testify? It would seem

    that adequate protection would be on duty and it would also be useful for

    the judge to see the attitudes of the offenders when testimony from your

    daughter is going on inside the courtroom as opposed to on video. If she is

    on video she really shouldn't worry at all at the courthouse but always be

    on guard at school. To bad you can't move her to a new school or can you

    ask the judge to allow that?

    if only one girl actually attacked your daughter then only one can reallybe charged - it isnt a crime to not intervene - you can't get arrested for not stopping a mugger running away with a grannies purse...

    That's not true at all. In law anyone that is along with the offender on any

    type of crime is as responsible as the ones who are actually doing it. An

    example is when a driver for a get away car is arrested for the same

    offense as the people who stole the money from the bank. Or when a gang

    of men rape a woman and a few there don't but watch, they are as guilty

    but will get a reduced sentence perhaps.

    she's stubborn, she refuses to move schools, and to a certain degreee i cant blame her, she is doing really well in her school, and we have actually since the attack moved closer,

    she is to scared to face te girls again, and the video link was set up for her and her brother and friend, but she is affraid of being attacked by family members outside the court room,

    A slight misunderstanding of the offense. The actual charge against the second girl would be one of co-conspiracy, especially given the fact that she urged the first girl on.

    Yup...Non-Logical-Idea-Guy...is right, everything needs proof...their fingerprints on the victim, cameras, other peoples' recollections.

    Also if Tasha would play really good...not like she was just hurt but like she thought they were going to kill her, and she is young and innocent...and such...and the more tears the better. Judges love that.

    however - you said that the girls were arguing which 1 did the attacking? couldnt your daughter tell? if not and they were prepared to sacrifice each other one could try and pass a "i only didnt stop her because she threatened me with a ..."

    if tasha did hear actual words of being told what to do very clearly it might be better but then someone could also try to pass that if she was being attacked she may have been slightly disorientated etc

    but im sure 1 of them will get something

    ok i think we've established ur anger which is quite rightful but i thought u came heree for legal discussion/amateur advice - not showing ur dedication to your understanding of justice

    they will both get what they deserve and perhaps i was a little heted, and yes your right i came here for legal advice, or rather advice about what to expect in court room

    yeah i know and it worries me, because if these girls can just walk away (which is looking unlikely) how will i cope with it, how will my daughter cope? how will i sleep at nights knowing that i wasnt there to keep her safe, and that is my job.

    In some American neighborhoods it's becoming increasingly common for people not to press charges, not to testify in court, not even to speak to the authorities because of intimidation by gang members. I was on a jury ten years ago, and when we went back into court on the second day of the trial, every single eyewitness had changed his testimony. "I'm not sure." "It was dark." "I didn't get a good look at him." Many people have been killed simply for being seen talking to a cop after a crime. Now, by the time the cops get there, the scene is often completely deserted and when they knock on nearby doors people say they didn't hear the shots.

    If you're serious about your job being to keep her safe, then you can't do anything about what's already happened. But you can keep her safer in the future by overruling her decision to remain in this same crappy school. Take her somewhere where the other children are raised by their parents, not by fellow delinquents.
