    Under English Law, if someone is judged Insane, they are considered as a "Criminal Lunatic", can be "sectioned" under the appropriate Act, and then detained "pending Her Majesty's pleasure", ie. indefinitely. No criminal trial is required, and the "90 day" detention period argument is irrelevant.
