Epidemic in China: Suing Good Samaritans

    We've covered a few stories on this board that relate to slip and fall accidents or motor vehicle accidents in China where bystanders refuse to get involved out of fear of being targeted in civil law suits.

    Here are three examples of this:

    --Beijing Foreigner Extorted After Running Into Chinese Woman?--

    --Bystanders Surround But Dare Not Help Up Fallen Old Man--

    --2-Year-Old Girl Ran Over by Van & Ignored by 18 Bystanders--


    In all of these cases, a person was injured due to an accident and either people refused to help the injured person or if they did, the injured person extorted money from them. A couple native-born Chinese citizens commented:

    "Whoever called the ambulance is whoever payment is demanded from. There are so many incidents of false accident or injury claims in China. Those above who are saying that our countrymen have become numb, I want to ask simply: What would you do if you ran into this kind of thing? Don’t just blame this or that on this internet post, would you risk being accused of being the perpetrator? Would you be willing to dump your entire family’s savings into the endless vortex of accident compensation? You aren’t afraid of going to jail as the perpetrator? Have you not considered that one moment of greatness could mean your entire family losing their happiness with you? Do you know just how many Nanjing judge [case results] there are? Do you think it is only Nanjing? The consequences of moral turpitude is not something that you and I can rectify. We are just ordinary people. Seeing this kind of thing, I can only describe it as heart-breaking, but I would be numb/indifferent like those 18 people…because I am a normal person!!! Truly, if you fall in a public setting and you don't immediately blame a nearby passerby, you will look foolish to your friends and family. It is not a decision you make; it is an expectation!!"


    "Everyone pretends they don’t see, it is always like this, almost without exception. This is not about whether or not a person is cold-blooded or not cold-blooded, but it is definitely about there being a very serious problem in society. These days, it is better to be less involved than more involved. Getting involved may very well mean getting majorly screwed. There are really too many of these kind of precedents, and everyone has silently evolved from these observations. No one is more qualified than anyone else to criticize."

    What are all your thoughts about this legal snake pit that China has? What are some possible solutions, and from where do these problems originate? What could drive an entire nation of people to establish sue-happiness as a standard of behavior. This sort of a legal norm might even scare me from helping someone in certain situations. Use this thread to discuss your thoughts and feelings about the excessive false claims of injury and accident compensation in China.

    Somehow, in today's world... it just doesn't surprise me anymore. I mean, come on, you can sue someone for damn near anything now, the more outlandish the better it seems.

    All 50 states have good Samaritan laws. Here's ours in Texas:

    Article 6701d, Vernon's Civil Statutes ; Chapter 74, Civil Practice and Remedies Code Section 74.001

    LIABILITY FOR EMERGENCY CARE

    (a) a person who in good faith administers emergency care at the scene of an emergency or in a hospital is not liable in civil damages for an act performed during the emergency unless the act is willfully or wantonly negligent.

    (b) This section does not apply for care administered:
    (1) in expectation of remuneration;
    (2) by a person who was at the scene of the emergency because he or a person he represents as an agent was soliciting business or seeking to perform a service for remuneration;
    (3) by a person who regularly administers emergency care in a hospital or emergency room; or
    (4) by an admitting physician or a treating physician associated by the admitting physician of a patient bringing a health-care liability claim.

    No, it's very different. It's a lot, lot worse. I can't imagine crowds of people ignoring a 2 year old girl in a street and allowing her to be run over multiple times. There's a precedent for this in China; if you slip and fall, and someone's helps you or brings you to a hospital, you would be considered foolish to not try and extort that person for money. They also have no good samaritan laws to speak of there.

    Agreed, one should not believe everything they read on the web, especially web sites and blogs with a particularly political agenda. One has to apply a little bit of common sense here too. If China has a problem with frivolous law suits, it certainly isn't hurting companies or anyone doing business in China or China's economic development. On the contrary, American companies have had great difficulty enforcing trade agreements and intellectual property rights through the Chinese courts and administrative agencies.

    China is really guilty of many atrocities including prison labor, suppression of free speech, harvesting organs of executed prisoners among other repugnant activities. China opponents don't need to water down some real legitimate complaints and their credibility with dubious or false allegations.

    You forgot animal abuse. China is officially one of the worst animal rights abusers in the world, in addition to their human rights abuses. Indeed, China's economic growth should be lauded; not many developed countries could stomach utilizing the parasitic business and labor practices of the Chinese.

    At least in the USA, we don't put a bullet a corporation's president when he screws up. There was a dog food manufacturer in China that accidentally poisoned the dog food and several dogs died from it. The company president was put to death.
