Except in some countries, or in some people's minds.

The rest is pretty easy from the rule of law: If Trump is impeached and convicted, barred from office, Mike Pence will take over.

If the leftists who want to destroy the country choose to impede the Constitutional succession of power in that case, we might have some problems. To put it mildly.

It seems that loonies that want Trump out want Pence in.
Do these crazies want the Koch brothers running the country?

Fuzzy headed liberals can't think 2 moves ahead?
Some days, I get the feeling that they are the oft mentioned "knee jerk liberals".

You might be closer to the mark with just "jerk liberals".

I was a yellow-dog Democrat until the left started this nonsensical series of attacks on everyone who doesn't like a rainbow flag, or makes the soul-damning mistake of calling a hairy 300-pound dude with biker tattoos a "woman" if it so chooses.

I won't vote for the Democrat party until someone kicks their collective (ist) heads out of the wonderful and warm place that they have it. Smelly, but it a "safe space", right?

why not? While I'm wary of the ugly precedent it would make and given the criminality of the republican party dangerous but if it was shown that trump was elected through illegal means why cant't you declare the election illegitimate? I would argue it would be more dangerous not to. We have to put a hard stop to the idea we feel it acceptable and legal to manipulate our elections, to not do so is basically inviting more people to try and more blatantly. Are you ok with rewarding criminality?

You don't know a damned thing. English, punctuation, reasoning ability.. Probably many more things, but the most important is that you are fucking stupid, and will never know it. Revel in your imagined superiority.

This is what I am trying to get a sense of: without a precedent, what are the arguments to be made for or against declaring an election illegitimate? The link in Capracus's post (#15, I think) touch upon this, but not in great detail.

I think the only thing that can make an election held two years ago illegal is corruption. Not by the idiots Trump uses to make himself feel smarter, but by the rabid fools on the left.

The "election cycle" is as damned idiotic as the "news cycle". Instead of pushing and shoving and materially stopping the government from what it does badly, too many people can't remember anything from more than twelve years ago.

Maybe that's because of America's wonderful educational system, maybe it's because of Monsanto, maybe Justin Trudeau has been exporting soy milk to California and New York, but it's fucking ridiculous to read things from historical illiterates and take the"one true voice" as stone-carved fact.

Read, people. Read something other than exceprts from Fox or CNN, and above all, learn to think.

I know it's too late for some folks that might read this post, but screw 'em anyway.

Yet.. the office of POTUS is established constitutionally is it not?
The president only has power because it is constitutional for him to have such.
No constitutional founding/protection = no POTUS
If the POTUS was found to be unconstitutionally elected then he is not a POTUS and would have no legal power to be so.

and what is it that established whether legal or not ( if not the constitution)?
The U.S. Constitution is the nation's fundamental law. It codifies the core values of the people. Courts have the responsibility to interpret the Constitution's meaning, as well as the meaning of any laws passed by Congress. The Federalist # 78 states further that, if any law passed by Congress conflicts with the Constitution, "the Constitution ought to be preferred to the statute, the intention of the people to the intention of their agents."

So it follows that any breach of the law is unconstitutional, whether that be illegal parking of a vehicle, or fraudulent elections. Yes?

As far as I know ( which is really very little) there is no precedent thus a constitutional crisis would be the outcome if the election was found to be unconstitutional. (illegitimate)

Here in Australia we have recently gone through a situation where by many ministers of government were forced to resign due to being in breach of our constitution regarding duel citizenship. The (Federal) High Court determined that they were ineligible to hold any position in Government. Thus their elections were deemed illegal, thus invalid and void. New elections were called and subsequently carried out.
The infamous Peter Dutton (PM wanna be) is currently also potentially in breach of our constitutionally derived conflict of interest laws and may yet be forced to resign.

You'll notice that I don't make assumptions about Australian politics based on U.S. politics.
