    just because a is worse than b doesn't make b not a crime. Rape and murder are worse than petty theft but that doesn't mean that petty theft ISN'T a crime

    The US specifically defines what a war crime is.
    It does not include pissing on corpses.

    And arguably, pissing on something does not equal "grossly abusing it", as a slight rinse and the body is as good as new.

    As far as that actual law goes, I think it's totally BS.

    Just imagine I die at home and my mate, who really enjoyed our sex life, gives my penis a kiss goodbye, IS now A 2nd Degree FELON?

    Really?

    Put her in PRISON for up to 15 years and list her as a Sexual Felon seem about the right to you Gustav?

    Go find some more ridiculous religious based laws Gustav, they are pretty funny.

    Seriously though, why do you defend assholes simply because they wear a uniform? You defended the cop who stalked someone he ticketed and now you defend these meatheads. What is it about a uniform which puts stars in your eyes? These (and the cop) are a disgrace to your country, the uniform, and those who wear it and defending them just devalues the rest of those who serve

    I ask again since you keep dodging it- if some Taliban fighters were caught pissing on or otherwise desecrating a US corpse, should they be punished for it any differently than you would expect if a US soldier did it to one of theirs? Do you believe the US should be held to a different standard than any other country or military?

    A person makes a small mistake doing some very stupid things during battle in which they were almost killed themselves and you want to throw the book at them ? Not to defend them but give them a dressing down and remind them they will be having more serious problems if they do this again would be enough in my opinion. Asking another to kill for their country then putting them in jail for doing some really stupid thing like this isn't what I'd think very reasonable.

    I said their actions were understandable effects of being in combat (for which there are thousands of examples, the only difference here is the advent of the internet, look up "ear necklaces" from the Vietnam war for instance).
    I said they were likely to be punished for their lack of judgement.
    I've said that the penalty should be PROPORTIONAL to the crime, and in this case, in the scheme of things, to me, that does not justify putting them in prison.

    Because he didn't stalk her based on the legal definition of stalking and I always said, the punishment again should be PROPORTIONAL to the infraction, which in this case was going to her address and leaving a single polite note asking her out, on her car. So IMHO he made a minor error of judgement. Assuming he has an otherwise good record firing him or putting him in jail seems ridiculous. A reprimand and some retraining seem much more appropriate.


    Because they DO serve.
    And they do so in often dangerous situations so the rest of us don't have to.
    So yeah, I give them a little leeway.

    When that person creates a precedent for the enemy to follow, does that really help us in any way? Should we tolerate morons who go out of their way to disrespect an occupied country we're trying to win over to our side? Maybe if those Taliban were caught on video sodomizing some children right before they got shot I could understand the denial of their basic dignity, but if they're brainwashed into believing they're defending themselves from a foreign aggressor, why should we tolerate a soldier who goes out of their way to justify such beliefs?

    we aren't talking about conscripts here, we are talking about people who have chosen to put themselves in these situations (both this one AND the cop). I herd of a case of an intern paramedic who changed a patients stats on a case card, they were fired immediately and will never work again because of that. If they had fronted the coroners court the most that would have happened is extra training. There are certain standeds of behaviour which go with certain professions which we wouldn't expect of Joe blow off the street, if those professions are government work then they may well be breaches of the law. Everyone knows that going in, he would have been issued a copy of the relevant hand book and after the issues with Abu Gaid and the incident of the US solders collecting ears, I'm sure they were required to go through refresher training on the standeds of behaviour that the US government expects of them. From memory an SAS solder\s was caught taking photos with the dead, he was instantly terminated from the ADF and I would be surprised if he didn't\wouldn't face charges (there is some turmoil recently in the uniform justice system in Australia because the high court ruled it illegitimate so the government has had to go back to the old system and is trying to reinstall a new system)

    I watched the uncensored video, lasting no more than a minute, and I was astonished by the sheer lack of spirit that I would normally expect such an act to accompany.

    No mad laughter to compliment the absurdity. No virile reveling over the audacity. No smug vitality. No unruly sway of the hip muscles. No vibrant sprays.

    In short: America is turning into a tasteless clunker—spontaneity and cheerful delinquency has drained away. All that's left is a ghost of a pride going through the motions.

    And I think that's the subliminal message being received by the global community.

    That's covered in 1 C of the Florida Statute you posted.

    Notice that the Florida Statute doesn't use the word DESECRATE.

    Because that would make the religious connection obvious.

    By using the term "abuse of a dead human body" they kind of skirt around that whole religious connection even though the only compelling reason the State has in you not disturbiing a body is so an ME can determine cause of death, but assuming that isn't being done, the rest of that law is total puritanical religious inspired BS.

    Or Gustav, are you one of those who was out protesting Gunther von Hagens art exhibits, like the Roman Catholic Church, who found it sinful?

    Maybe if you want to side with those who would foist their rigid beliefs on the rest of us, you know, the same desire to control what others do that made consensual sexual acts illegal in 14 states until the Supreme Court threw those laws out in 2003.

    Americans are a surprisingly moral bunch of people, and they need to know that their moral standards are being represented abroad. People also deal with the evil they know, and although many people were misled about the cause for war, the actions here are very wrong ... simply, clearly and unambiguously wrong.

    I agree both types should be held accountable, but we're talking about two mass murderers (whose nations clamored for action) on the one hand, and on the other, probably dozens of idiots (at least) and hundreds of thousands of potential idiots.

    The minimum penalty for this handful of idiots who couldn't keep it in their pants — spread their names all over the media, give them a dishonorable discharge, zero rights as veterans (not even special license plates or points toward obtaining govt jobs), and let it be a lesson to the rest of the potential idiots. Bare minimum. They should actually receive stiff brig time for creating an international incident that badly represents America. Otherwise, it will be viewed as: Do it, but don't record it.

    Go ahead, try to convince me that universally offensive stuff like this doesn't help fuel more idiotic terrorists to fly more airliners into more skyscrapers.
