Well, technically yes - though they would wind up violating laws in multiple countries, it would still be their choice (and as such, they would have to live with the consequences of such an action). The point still stands, though, that by registering on and using these forums you agree to abide by the rules set by the owners and staff. It's really no different than much of the worlds businesses to be honest - just here you don't pay for the "service" of having a place for discussion.

You could have written, for example: "Cain, you incompetent little retard". Then there would have been no question as to who you meant to address.

Seriously. One makes mistakes, and many other people make up for them. So one should also be generous to make up for the mistakes of others.

You sometimes tread the thin line of little or no generosity, especially in these SFOG threads.
And while it is possible to convincingly argue for such a stance, it is not a community-building stance.
