So are Jews, Armenians, Maoris, Australian aborigines, et. al., and look what happened to them.

Hopefully, we've grown up a bit since then.

So if they are both hoverflies, why the distinction ?

Neanderthals are of the genus homo, so they are men biological and if the can think they are sapiens (wise men think/wise? Paris hilton is considerd official human)
    a human is homo sapiens

The topic reminds me of an early 90's television drama "Chimera".

Where peoples fears of science can be taken and distorted. (Similar to "Frankenstein")

As for if Neanderthals have rights?

Well admittedly just using Wikipedia as an unverified source can be academic suicide, so take it as it is:
If this was verified, then it would suggest that they used tools and had social interaction beyond that of "animals". So in every essence they would have to have rights. However there are a number of concerns that could be raised, I mean to bring a species back that's sentient with the capability of learning beyond that of pets, would indeed place their rights to privacy into question, which they obviously wouldn't have since they would be created to be a "sideshow freak".

Being birthed from a Chimp itself could be insultive, even if it was it's mother.

if we were really going to do this why wouldnt you use a human mother?
after all WE are the closest relitives to them, not chimps

Ethical issues in research. You'd never get any research organisation to approve.

could a chimp even give birth to a neaderthaul?
I dont know much about there physiology but im assuming they are around the same hight as us with a similar sized head (i think i herd that there head was actually LARGER than ours). A chimp is about half the hight of a human and has a much smaller head

There for a) the baby wouldnt fit through the birth cannal and b) the baby probably would be born very premie and\or kill the mother because it is to large for the mother

And I would hope that such neanderthals would have rights. Not that you'd expect every country in the world to follow that.
