    Steve Rogers is who made Captain America who he was.

    Anyone who'd been following Civil War, can understand where he's coming from in the talk between him and Peter Parker.

    The major theme in Civil War has been between doing what is legal in regards to protecting the population from "Supers", and doing what is right in regards to personal freedoms. It's a direct reflection of the current state of affairs in the US in consideration of the Patriot Act, Department of Homeland Security, the Immigration and Naturalization Service, the wars in Iraq and Afgahnistan, Guantanemo Bay prisoners, and renditioning programs. In this case, Capt America AKA Steve Rogers, came in on the side of the freedom fighters. Peter Parker AKA Spiderman, initially joined with the government in policing supers, but had an epiphany and resigned (not without resistance) to join the personal rights group.

    Rogers, as Captain America, represents the Great American Ideal. In the comic, the Government of the United States of America created the conditions that lead to the death of the very ideal of America. The worst part is, Marvel Comics is dead on with what's happened to America in real life. We have sacrificed our freedoms for so-called security and have also lost the very things that made America a unique, desireable place for everyone in the world to come to. And the rest of the world recognizes that America today has lost the very things that made us great.

    That is nonsense. Name one freedom we have actually lost during the Bush administration. Similarly, tell us exactly how detaining and killing terrorists is against our "freedom" or "American values"?

    - increase how much information the government may obtain about users from their ISPs or others who handle or store their online communications WITHOUT A COURT ORDER OR SUBPOENA
    - new definition of terrorism and three expansions of previous definitions also expand the scope of surveillance... expose more people to surveillance (and potential "harboring" and "material support" liability
    - Government spying on suspected computer trespassers with no need for court order
    - Adding samples to DNA database for those convicted of "any crime of violence
    - Wiretaps now allowed for suspected violations of the Computer Fraud and Abuse Act
    - Dramatic increases to the scope and penalties of the Computer Fraud and Abuse Act
    - Allows Americans to be More Easily Spied Upon by U.S. Foreign Intelligence Agencies
    - FISA authority to spy on Americans or foreign persons in the U.S. (and those who communicate with them) increased from situations where obtaining foreign intelligence information is "the" purpose of the surveillance to anytime that it is "a significant purpose" of the surveillance
    - Increased information sharing between domestic law enforcement and intelligence. This is a partial repeal of the wall put up in the 1970s after the discovery that the FBI and CIA had been conducting investigations on over half a million Americans during the McCarthy era and afterwards, including the pervasive surveillance of Martin Luther King in the 1960s. It allows wiretap results, grand jury information and other evidence collected in a criminal case to be disclosed to the intelligence agencies when the information constitutes foreign intelligence information
    - Domestic surveillance limits can be skirted by the Attorney General, for instance, by obtaining a FISA wiretap against a U.S. person where "probable cause" does not exist, but when the person is suspected to be an agent of a foreign government.
    - As currently worded, the president (or members of the executive branch of government such as DoJ) can declare anyone a terrorist and remove them from even the currently existing protections of a citizen under the U.S. Constitution

    And the list of lost freedoms under this administration goes on and on.

    As for the "detaining and killing terrorists is against our "freedom" or "American values"

    First of all, by the Bush definition, the Gitmo detainees are all terrorists. However, just defining a person as a terrorist because you say they are is both immoral and unethical.

    Secondly, treatment of the Gitmo detainees, and the Abu Gharib prisoners, and renditioned captives is against the Geneva Convention. As a miltary retiree, I KNOW this is wrong. It's also wrong to classify these people as non-military criminals, and then hold them without a free and open trial. Arguements that they have valuable intelligence information is a spurious arguement - they have been out of touch for so long that none of their 'information', if they had any, is of any use at this point. Ditto the arguement against open trials because it would reveal classified information. Information is only supposed to be classified for the minimum length of time necessary to protect an operation. The world already knows the methods being used to intercept intelligence information that "bagged" these people. Finally, the American Concept of Innocent Until Proven Guilty still holds. Without a trial, these detainees are all still technically innocent of any crime. The only reason for initially holding them is because they were captured in a combat situation. They need to be released and repatriated back to their native countries.
