I think Avril probably didn't know the song was stolen, but here's the point Mr. Absanity... the primary lyrics in these songs are identical, therefore we must assume they are stolen. Hell if I came out with a song and it had everything different but fell apart without the same lyrics as yours wouldn't that be plagerism. Certainly it would because if she took out hey hey hey I wanna be your girlfriend her song would fall to pieces, and that's precisely what the other songs about. Somebody made a big mistake, and it's not a good one...
She might write her songs. She's good at it (they are catchy), altough I hate her arrogant attitude. She's my wife's cousin, but we don't have much respect for her.... Anyways... Nelly Furtado in the other hand... big dissapointment. Specially for me, because we both speak Portuguese. She doesn't write any of her songs anymore and machines change her voice to appear not nasal. Just compare her earliest video(s) with the latest. Her style used to be much more interesting and personal. Now she's just another corporate puppet. What a shame....

Regardless of her pathetic personality, I think Avril's song is a coincidence, and does not sound similar at all. She is innocent.
