New virtual surgery trainer allows surgeons to train on a patient before actually doing that surgery. Not only that, but it can tell if the surgeon is drunk, tired, or should not be performing that surgery. Will surgeons now have to worry about the level of the care they expend to patients while the patient is conscious?

I remember seeing something similar to this on BBC's Tommorow's World about eight months ago.
There is a 3d visual system either through coloured lenses or a headset, and the manipulator has a variable level of resistance to simulate the way the operation feels.

Will surgeons now have to worry about the level of the care they expend to patients while the patient is conscious?

Not quite sure what you mean by this, can you clarify?

What I get for not proof reading. Try unconscious...

The thought was that if this can also monitor the surgeon during an operation then there will be a record existing that could be of benefit to the patient should it be a case of medical malpractice.

I would say that the level of the care provided itself would not be in jeopardy, it would be more a case of the surgeon needing to be certain that (i) they are confident in their ability to perform the procedure, and (ii) they are fit to do so.
A knock on from this, however, is that if there's the slightest doubt in the surgeon's mind, they will think twice about performing the procedure themselves.
