No, it isn't. Moderators can issue warnings. After a warning, if you repeat the offence, they may ban you, if neccessary.
Just like it always has been with the addition of formal warning ("you have been warned" type of thing).

Nobody is giving out infractions, even if the software module hasn't been uninstalled.

I still recommend the forced use of George Bush/Michael Moore/Hilary Clinton avatars as a punishment instead of banning. (which avatar depends on the political persuasion of the offender.)
